Recovery Client Agreement

This Recovery Client Agreement (“Agreement”) is entered into between Digjy LLC, the owner and operator of RecoveryBuddy AI (“RecoveryBuddy AI,” “we,” “our,” or “us”), and each individual who registers for or uses the RecoveryBuddy AI platform as a Recovery Client, participant, member, or end user (“Client,” “you,” or “your”).

This Agreement governs your access to and use of the RecoveryBuddy AI website, mobile applications, WordPress plugin, artificial intelligence services, recovery journals, recovery plans, messaging, Peer Recovery Coach features, recovery meetings, educational resources, provider tools, community features, and all related products and services (collectively, the “Platform”).

This Agreement should be read together with the RecoveryBuddy AI Terms of Service, Privacy Policy, Medical Disclaimer, Mental Health Disclaimer, Crisis Support Disclaimer, Community Guidelines, and all other applicable legal policies.

By creating an account or using the Platform, you agree to be legally bound by this Agreement.

Eligibility

By registering for RecoveryBuddy AI, you represent and warrant that:

  • You are at least eighteen (18) years of age or the age of majority in your jurisdiction, whichever is greater, unless your use is authorized by a parent, legal guardian, healthcare provider, treatment organization, or other authorized representative where permitted by applicable law.

  • You have the legal capacity to enter into this Agreement.

  • The information you provide is accurate, current, and complete.

  • You will keep your account information updated.

RecoveryBuddy AI may request identity verification where appropriate.

Purpose of the Platform

RecoveryBuddy AI is designed to provide technology that supports individuals throughout their recovery journey.

The Platform may provide:

  • AI-powered recovery support.

  • Recovery journaling.

  • Recovery planning.

  • Goal tracking.

  • Progress monitoring.

  • Educational resources.

  • Recovery meetings.

  • Peer Recovery Coach connections.

  • Secure messaging.

  • Provider communication.

  • Wellness tools.

  • Recovery reminders.

  • Community participation.

The Platform is intended to complement—not replace—professional healthcare and recovery services.

No Medical or Clinical Care

You acknowledge and agree that RecoveryBuddy AI:

  • Is not a hospital.

  • Is not a treatment center.

  • Is not a medical provider.

  • Is not a mental health clinic.

  • Is not a counseling practice.

  • Is not an emergency response service.

The Platform does not provide:

  • Medical advice.

  • Mental health treatment.

  • Addiction treatment.

  • Clinical diagnosis.

  • Medication management.

  • Emergency services.

Always seek advice from qualified healthcare professionals regarding your medical, behavioral health, or recovery needs.

Artificial Intelligence

RecoveryBuddy AI includes artificial intelligence tools intended to assist with education, recovery planning, organization, journaling, motivation, and wellness support.

You understand that AI-generated information:

  • May contain inaccuracies.

  • May be incomplete.

  • May not apply to your personal circumstances.

  • Does not replace licensed professionals.

  • Should be independently evaluated before acting upon it.

You remain solely responsible for decisions made based upon AI-generated information.

Peer Recovery Coaches

RecoveryBuddy AI may allow you to connect with Peer Recovery Coaches.

You understand and agree that:

  • Peer Recovery Coaches are generally independent users of the Platform.

  • Peer Recovery Coaches are not employees or agents of Digjy LLC unless expressly stated in a separate written agreement.

  • Peer support is based on lived experience and encouragement.

  • Peer Recovery Coaches generally do not provide medical or clinical treatment through the Platform.

You are responsible for determining whether peer support is appropriate for your individual circumstances.

Healthcare Providers

RecoveryBuddy AI may allow communication with healthcare providers, treatment organizations, counselors, behavioral health professionals, or other authorized providers.

Those professionals remain solely responsible for:

  • Clinical decisions.

  • Professional judgment.

  • Medical treatment.

  • Behavioral health services.

  • Compliance with applicable laws.

RecoveryBuddy AI does not supervise or direct their professional services.

Recovery Meetings

RecoveryBuddy AI may provide access to:

  • Recovery meetings.

  • Peer support groups.

  • Educational sessions.

  • Group discussions.

  • Community events.

Participation is voluntary.

You agree to:

  • Respect confidentiality.

  • Treat participants respectfully.

  • Follow meeting rules.

  • Avoid disruptive behavior.

  • Comply with Community Guidelines.

Messaging

RecoveryBuddy AI provides communication tools to facilitate recovery-related interactions.

You agree to use Messaging Services respectfully and lawfully.

You shall not use the Platform to:

  • Harass others.

  • Threaten violence.

  • Commit fraud.

  • Send spam.

  • Share malicious software.

  • Disclose confidential information without authorization.

  • Violate applicable law.

RecoveryBuddy AI may investigate reported misuse of Messaging Services.

Your Responsibilities

You agree to:

  • Provide accurate information.

  • Protect your login credentials.

  • Maintain the confidentiality of your account.

  • Use the Platform responsibly.

  • Respect the privacy of others.

  • Comply with applicable laws.

  • Follow RecoveryBuddy AI policies.

  • Seek professional care when appropriate.

You remain solely responsible for decisions affecting your recovery and healthcare.

Privacy

RecoveryBuddy AI processes personal information in accordance with its Privacy Policy and applicable laws.

You acknowledge that:

  • Information you voluntarily submit may be processed to provide Platform services.

  • Certain information may be shared with authorized users where you provide consent or where permitted by law.

  • RecoveryBuddy AI maintains safeguards designed to protect user information.

You should carefully consider the information you choose to share with other users.

Account Security

You are responsible for maintaining the security of your account.

You agree to:

  • Use a strong password.

  • Protect your credentials.

  • Enable multi-factor authentication where available.

  • Notify RecoveryBuddy AI promptly of suspected unauthorized access.

You are responsible for activities occurring under your account unless prohibited by applicable law.

Fees and Payments

Certain Platform features or subscriptions may require payment.

You agree to pay applicable fees in accordance with the pricing and payment terms presented at the time of purchase.

Failure to pay required fees may result in suspension or termination of access to paid services.

Intellectual Property

RecoveryBuddy AI, including its software, AI systems, branding, documentation, interfaces, workflows, graphics, and related technology, remains the exclusive property of Digjy LLC or its licensors.

This Agreement grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your personal, non-commercial recovery support purposes.

Suspension and Termination

RecoveryBuddy AI may suspend or terminate your account if you:

  • Violate this Agreement.

  • Violate Community Guidelines.

  • Engage in fraud.

  • Harass other users.

  • Abuse AI features.

  • Circumvent Platform security.

  • Provide false information.

  • Engage in unlawful conduct.

You may discontinue use of the Platform at any time.

Disclaimer of Warranties

THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DIGJY LLC DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, OR CONTINUOUS AVAILABILITY.

RecoveryBuddy AI does not guarantee recovery success, sobriety, relapse prevention, treatment outcomes, or uninterrupted access to the Platform.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIGJY LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO:

  • Use of the Platform.

  • AI-generated information.

  • Peer Recovery Coach interactions.

  • Provider interactions.

  • Recovery meetings.

  • Messaging.

  • Recovery outcomes.

  • Platform interruptions.

  • Technical failures.

Any liability that cannot legally be excluded shall be limited as provided in the RecoveryBuddy AI Terms of Service and applicable law.

Indemnification

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Digjy LLC, RecoveryBuddy AI, its affiliates, officers, directors, employees, contractors, licensors, and agents from and against claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from:

  • Your breach of this Agreement.

  • Your misuse of the Platform.

  • Your violation of applicable law.

  • Content you upload or share.

  • Your infringement of third-party rights.

This indemnification obligation does not apply to the extent a claim arises from Digjy LLC’s own negligence, willful misconduct, or other liability that cannot be disclaimed under applicable law.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of laws principles.

Any disputes shall be resolved in accordance with the dispute resolution provisions contained in the RecoveryBuddy AI Terms of Service.

Changes to This Agreement

RecoveryBuddy AI may update this Agreement periodically to reflect changes in applicable law, Platform functionality, business operations, or industry standards.

Updated versions will be posted on the RecoveryBuddy AI website with a revised Last Updated date.

Your continued use of the Platform after updated terms become effective constitutes acceptance of the revised Agreement.

Acceptance

By creating a RecoveryBuddy AI account, participating in recovery meetings, communicating with Peer Recovery Coaches or providers, using AI-powered features, maintaining a recovery journal, or otherwise accessing the Platform, you acknowledge that you have read, understood, and agree to be legally bound by this Recovery Client Agreement.

If you do not agree to this Agreement, you must not access or use the RecoveryBuddy AI Platform.
