These Terms of Service (“Terms”) govern your access to and use of the RecoveryBuddy AI website, mobile applications, WordPress plugin, dashboards, artificial intelligence services, messaging features, recovery journals, recovery planning tools, educational resources, recovery meetings, provider portals, peer recovery network, organization dashboards, APIs, software, and all related products and services (collectively, the “Platform”).

“User Content” means any information submitted, uploaded, posted, transmitted, stored, or otherwise made available by users through the Platform.

Acceptance of These Terms

These Terms constitute a legally binding agreement between you and Digjy LLC.

By creating an account or using the Platform, you represent and warrant that:

Reservation of Rights

Peer Recovery Coaches using the Platform are independent users.

Unless expressly stated in a separate written agreement, Peer Recovery Coaches are not employees, agents, partners, representatives, or legal affiliates of Digjy LLC.

RecoveryBuddy AI does not supervise, direct, or control the professional judgment or services provided by Peer Recovery Coaches.

Responsibilities of Peer Recovery Coaches

Peer Recovery Coaches agree to:

• Maintain all required certifications or credentials.

• Comply with applicable laws and ethical standards.

• Respect user confidentiality.

• Communicate professionally.

• Avoid discrimination or harassment.

• Use the Platform responsibly.

• Maintain accurate information.

• Report suspected misuse of the Platform.

RecoveryBuddy AI may suspend or terminate coach accounts that violate these Terms or applicable law.

Treatment Providers

Licensed treatment providers, clinicians, counselors, therapists, physicians, nurses, psychologists, social workers, behavioral health professionals, and healthcare organizations using the Platform remain solely responsible for all professional services they provide.

RecoveryBuddy AI does not supervise, direct, or control clinical decision-making.

Provider Responsibilities

Organizations

Failure to provide requested verification may result in restricted access, suspension, or termination of provider accounts.

Verification by RecoveryBuddy AI does not constitute endorsement, accreditation, certification, or a guarantee of competency.

Independent Professional Judgment

Healthcare providers, Peer Recovery Coaches, and organizations retain sole responsibility for exercising independent professional judgment when using the Platform.

Nothing within RecoveryBuddy AI—including AI-generated content, recommendations, summaries, reports, reminders, or educational materials—should replace professional evaluation or decision-making.

No Guarantee of Professional Relationships

RecoveryBuddy AI does not guarantee compatibility, effectiveness, availability, or outcomes between recovery clients and Peer Recovery Coaches, providers, or organizations.

Users are responsible for determining whether a provider or coach is appropriate for their individual needs.

Third-Party Healthcare Services

RecoveryBuddy AI may provide tools that facilitate communication with third-party healthcare providers or organizations.

RecoveryBuddy AI is not responsible for:

• Professional services provided by third parties.

• Clinical advice.

• Treatment decisions.

• Medical outcomes.

• Provider availability.

• Appointment scheduling performed by third parties.

Any relationship between users and third-party providers exists independently of RecoveryBuddy AI.

Reservation of Rights

RecoveryBuddy AI reserves the right to investigate, suspend, restrict, or terminate the accounts of coaches, providers, organizations, or other users whose conduct may threaten the safety, integrity, security, or lawful operation of the Platform.

Nothing in these Terms limits RecoveryBuddy AI’s ability to cooperate with lawful requests from governmental authorities or regulatory agencies or to take reasonable action to protect users, the Platform, or the public where permitted or required by law.

RecoveryBuddy AI allows users to create, upload, submit, publish, transmit, receive, store, and share various forms of content through the Platform (“User Content”), including but not limited to:

• Other information submitted through the Platform

You retain ownership of your User Content. These Terms do not transfer ownership of your intellectual property to RecoveryBuddy AI.

License Granted to RecoveryBuddy AI

By submitting User Content to the Platform, you grant Digjy LLC a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to:

• Store

• Cache

• Process

• Display

• Reproduce

• Modify (solely for formatting, accessibility, security, moderation, and technical compatibility)

• Distribute

• Transmit

• Backup

• Analyze

• Index

your User Content solely for the purposes of:

• Operating the Platform

• Providing requested services

• Improving Platform functionality

• Providing AI-assisted features

• Maintaining security

• Detecting fraud and abuse

• Complying with legal obligations

• Enforcing these Terms

This license ends when your User Content is permanently deleted from the Platform, except where retention is required by law, court order, legitimate business purposes, backup systems, or active legal disputes.

Responsibility for User Content

You are solely responsible for all User Content you create, upload, publish, transmit, or otherwise make available through RecoveryBuddy AI.

You represent and warrant that:

• You own the necessary rights to your User Content.

• You have permission to upload any content belonging to others.

• Your User Content does not violate any law.

• Your User Content does not infringe intellectual property rights.

• Your User Content does not violate privacy rights.

• Your User Content is not defamatory.

• Your User Content does not contain malicious software.

RecoveryBuddy AI assumes no responsibility for User Content created by users.

Prohibited Content

Users may not upload, publish, transmit, or distribute content that:

• Violates applicable law.

• Encourages criminal activity.

• Promotes violence.

• Promotes terrorism or extremist activities.

• Encourages illegal drug trafficking.

• Encourages unlawful conduct.

• Contains child sexual abuse material.

• Exploits or endangers minors.

• Contains malware or harmful code.

• Infringes copyrights, trademarks, patents, or trade secrets.

• Violates another person’s privacy.

• Contains fraudulent or deceptive information.

• Impersonates another individual or organization.

Violation of these rules may result in suspension or termination of Platform access.

RecoveryBuddy AI may allow users to create private or shared recovery journals.

Users remain responsible for information entered into their journals.

RecoveryBuddy AI recommends that users avoid storing highly sensitive information unless they understand and accept the associated privacy risks.

Where journaling features are shared with providers, coaches, sponsors, or organizations, users acknowledge that authorized recipients may access journal entries as configured by the user or required by applicable functionality.

Messaging Services

RecoveryBuddy AI may provide messaging features between:

• Peer Recovery Coaches

• Sponsors

• Family Members

• Healthcare Providers

• Organizations

• Moderators

• Administrators

Messaging services are intended to facilitate communication and collaboration.

RecoveryBuddy AI does not guarantee delivery, availability, confidentiality beyond implemented security measures, or continuous monitoring of messages.

Users are responsible for exercising appropriate judgment when communicating through the Platform.

Messaging Conduct

Users agree that messages transmitted through the Platform will not:

• Contain threats.

• Contain harassment.

• Contain discriminatory language.

• Contain unlawful solicitations.

• Promote violence.

• Promote illegal activity.

• Include malicious software.

• Infringe intellectual property.

• Misrepresent identity.

• Contain fraudulent information.

RecoveryBuddy AI reserves the right, where permitted by law and consistent with applicable privacy obligations, to investigate reported misuse of messaging features.

Recovery Meetings

RecoveryBuddy AI may provide technology supporting:

• Organization meetings

• Provider meetings

RecoveryBuddy AI provides the technology platform but is generally not the organizer, sponsor, or facilitator of meetings unless expressly identified as such.

Meeting hosts are responsible for managing their sessions.

Meeting Rules

Participants agree to:

• Behave professionally.

• Avoid disruptive conduct.

• Follow host instructions.

• Respect speaking opportunities.

• Refrain from abusive language.

• Avoid recording meetings without permission.

• Maintain confidentiality where appropriate.

RecoveryBuddy AI may remove users who disrupt meetings or violate these Terms.

Recording Meetings

Unless expressly authorized by all legally required participants and permitted by applicable law, users may not record, livestream, copy, or distribute recovery meetings conducted through the Platform.

Meeting hosts are responsible for complying with all applicable consent laws regarding recording.

RecoveryBuddy AI is not responsible for unauthorized recordings made by users.

Content Moderation

RecoveryBuddy AI may, but is not obligated to, review, moderate, remove, restrict, disable, or refuse User Content that it reasonably believes:

• Violates these Terms.

• Violates Community Guidelines.

• Violates applicable law.

• Creates safety risks.

• Threatens Platform integrity.

• Infringes intellectual property.

• Harms other users.

• Interferes with Platform operations.

Failure to remove content does not constitute approval or endorsement.

Reporting Violations

Users are encouraged to report suspected violations of these Terms, Community Guidelines, intellectual property rights, or unlawful conduct.

RecoveryBuddy AI may investigate reports and take actions it deems appropriate, including:

• Warning users.

• Removing content.

• Suspending accounts.

• Permanently terminating accounts.

• Reporting unlawful conduct to appropriate authorities where required or permitted by law.

Intellectual Property Ownership

Except for User Content, all rights, title, and interest in the Platform are owned by Digjy LLC or its licensors.

This includes, without limitation:

• Software

• Source code

• Artificial intelligence systems

• Algorithms

• Machine learning models

• Platform architecture

• User interfaces

• Graphics

• Logos

• Icons

• Branding

• Trademarks

• Service marks

• Copyrights

• Databases

• Documentation

• Videos

• Educational materials

• Text

• Designs

• APIs

• Workflows

• Trade secrets

• Proprietary technology

These materials are protected by United States and international intellectual property laws.

Limited License

Subject to these Terms, Digjy LLC grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Platform solely for its intended purposes.

No ownership rights are transferred to you.

Restrictions on Use

Unless expressly authorized in writing, you may not:

• Copy Platform software.

• Modify Platform software.

• Reverse engineer the Platform except where non-waivable law permits.

• Decompile Platform software.

• Create derivative works based upon the Platform.

• Sell Platform software.

• License Platform software.

• Lease Platform software.

• Redistribute proprietary content.

• Remove copyright notices.

• Circumvent technical protection measures.

• Use automated scraping tools.

• Mine Platform data without authorization.

• Train artificial intelligence systems using Platform content without written permission.

• Use RecoveryBuddy AI trademarks without authorization.

Copyright Policy

RecoveryBuddy AI respects the intellectual property rights of others.

If you believe material available on the Platform infringes your copyright, you may submit a written copyright complaint containing sufficient information for RecoveryBuddy AI to evaluate the claim.

RecoveryBuddy AI may remove or disable access to allegedly infringing material while investigating reported claims.

Users who repeatedly infringe intellectual property rights may have their accounts terminated.

Feedback

If you submit suggestions, feature requests, recommendations, comments, ideas, or other feedback regarding the Platform, you grant Digjy LLC a perpetual, irrevocable, worldwide, royalty-free, transferable license to use, modify, reproduce, distribute, publish, display, incorporate, and otherwise exploit such feedback without compensation or attribution, except where prohibited by applicable law.

Reservation of Rights

RecoveryBuddy AI and Digjy LLC reserve all rights not expressly granted under these Terms.

Nothing in these Terms transfers ownership of any intellectual property belonging to Digjy LLC, its licensors, or other users.

Unauthorized use of the Platform or its intellectual property may result in suspension or termination of access, civil liability, criminal penalties where applicable, and any other remedies available under law or equity.

Payments, Privacy, Security, Warranties, Limitation of Liability, and Indemnification

Payments

Certain features, subscriptions, organizational services, premium tools, integrations, or other functionality offered through RecoveryBuddy AI may require payment.

By purchasing any paid service, you agree to:

• Pay all applicable fees, taxes, and charges.

• Provide accurate and complete payment information.

• Maintain a valid payment method.

• Authorize Digjy LLC and its authorized payment processors to charge your selected payment method for all amounts due.

Prices are displayed in U.S. Dollars unless otherwise indicated.

Digjy LLC reserves the right to modify pricing, subscription plans, service offerings, or billing practices at any time. Changes will not apply retroactively to amounts already paid unless required by applicable law.

Subscription Services

Certain RecoveryBuddy AI services may be offered through recurring subscription plans.

By enrolling in a subscription, you authorize recurring charges until the subscription is canceled in accordance with these Terms.

Subscription benefits may include access to premium AI services, enhanced recovery planning tools, organizational dashboards, provider tools, advanced reporting, integrations, additional storage, or other premium features.

Automatic Renewal

Unless otherwise stated, subscriptions automatically renew at the end of each billing period using your designated payment method.

You may cancel your subscription before the next renewal date to prevent future charges.

Cancellation does not entitle you to a refund for the current billing period unless required by applicable law or expressly stated in a separate refund policy.

Billing Errors

If you believe you have been charged incorrectly, you must notify Digjy LLC within thirty (30) days of the applicable charge.

Failure to timely report a billing concern may limit our ability to investigate or resolve the matter.

Payment Processors

RecoveryBuddy AI may utilize independent third-party payment processors.

Payment transactions are processed by those providers under their own terms, conditions, and privacy policies.

RecoveryBuddy AI does not store complete payment card information unless expressly stated.

Digjy LLC is not responsible for the security, availability, or performance of third-party payment processors.

Taxes

You are responsible for any applicable sales taxes, use taxes, value-added taxes (VAT), goods and services taxes (GST), withholding taxes, duties, governmental fees, or other legally imposed charges arising from your purchase or use of the Platform, except for taxes imposed on Digjy LLC’s income.

Refunds

Refund eligibility is governed by RecoveryBuddy AI’s separate Refund Policy.

Unless otherwise required by law or expressly stated in writing, payments are non-refundable.

Partial use of a subscription or service does not automatically entitle you to a partial refund.

Chargebacks

You agree to contact RecoveryBuddy AI before initiating a payment dispute or chargeback whenever reasonably possible.

Fraudulent or abusive chargebacks may result in:

• Account suspension.

• Termination of services.

• Collection efforts.

• Recovery of unpaid balances.

• Restriction from future purchases.

Nothing in this section limits rights that cannot legally be waived.

By using the Platform, you acknowledge that you have reviewed the Privacy Policy and understand how your information is processed.

RecoveryBuddy AI implements administrative, technical, and physical safeguards designed to protect information from unauthorized access, disclosure, alteration, or destruction.

Security measures may include:

No method of transmission or electronic storage is completely secure.

Accordingly, RecoveryBuddy AI cannot guarantee absolute security.

Your interactions with third parties are governed by their respective agreements.

• AI-GENERATED CONTENT WILL BE ACCURATE.

• AI RESPONSES WILL BE COMPLETE.

• AI OUTPUTS WILL BE SUITABLE FOR ANY PARTICULAR PURPOSE.

• SERVICES WILL ALWAYS BE AVAILABLE.

• THE PLATFORM WILL BE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

YOUR USE OF THE PLATFORM IS AT YOUR SOLE RISK.

Limitation of Liability

• BUSINESS INTERRUPTION

• LOSS OF ANTICIPATED SAVINGS

ARISING OUT OF OR RELATED TO:

• USE OF THE PLATFORM.

• INABILITY TO USE THE PLATFORM.

• AI-GENERATED CONTENT.

• USER CONTENT.

• THIRD-PARTY SERVICES.

• SECURITY INCIDENTS.

• DATA LOSS.

• SERVICE INTERRUPTIONS.

• MEETING PARTICIPATION.

• COMMUNICATIONS BETWEEN USERS.

• RECOVERY OUTCOMES.

• RELIANCE ON INFORMATION PROVIDED THROUGH THE PLATFORM.

TO THE EXTENT LIABILITY CANNOT BE EXCLUDED, THE AGGREGATE LIABILITY OF DIGJY LLC FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE PLATFORM SHALL NOT EXCEED THE GREATER OF:

(a) THE TOTAL AMOUNT PAID BY YOU TO DIGJY LLC DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR

(b) ONE HUNDRED UNITED STATES DOLLARS (US $100.00).

Some jurisdictions do not permit certain limitations of liability. Where prohibited by law, the foregoing limitations apply only to the maximum extent permitted.

Assumption of Risk

You acknowledge that participation in recovery-related activities, peer support communities, messaging, meetings, AI-assisted services, educational programs, and wellness activities involves personal decisions and inherent risks.

You voluntarily assume all risks associated with your use of the Platform.

Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Digjy LLC, RecoveryBuddy AI, its parent companies, subsidiaries, affiliates, licensors, contractors, service providers, employees, officers, directors, agents, successors, and assigns from and against any and all claims, demands, actions, proceedings, investigations, liabilities, damages, judgments, settlements, fines, penalties, losses, costs, and expenses, including reasonable attorneys’ fees and legal expenses, arising out of or relating to:

• Your use of the Platform.

• Your User Content.

• Your violation of these Terms.

• Your violation of applicable law.

• Your violation of the rights of another person or entity.

• Your misuse of AI-generated information.

• Your negligence or willful misconduct.

• Your interactions with other users, providers, organizations, or Peer Recovery Coaches.

Digjy LLC reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification. You agree to cooperate fully in the defense of such matters.

Force Majeure

Digjy LLC shall not be liable for any delay, interruption, or failure to perform its obligations under these Terms to the extent caused by events beyond its reasonable control, including but not limited to natural disasters, acts of God, pandemics, public health emergencies, war, terrorism, labor disputes, civil unrest, governmental actions, power failures, internet outages, cyberattacks, cloud service disruptions, or failures of third-party service providers.

Survival

The provisions relating to payment obligations, intellectual property, privacy, disclaimers, limitation of liability, indemnification, dispute resolution, and any other provisions that by their nature should survive termination shall survive the termination or expiration of these Terms.

Arbitration, Governing Law, General Provisions, Contact Information, and Final Clauses

Governing Law

These Terms of Service and any dispute, claim, controversy, or cause of action arising out of or relating to the Platform, these Terms, or your use of RecoveryBuddy AI shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of laws principles.

To the extent arbitration does not apply or a court proceeding is otherwise permitted under these Terms or applicable law, the state and federal courts located in Maricopa County, Arizona, shall have exclusive jurisdiction, and you consent to the personal jurisdiction of those courts.

Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Except where prohibited by applicable law, any dispute, controversy, or claim arising out of or relating to these Terms, the Platform, or any services provided by RecoveryBuddy AI shall be resolved exclusively through final and binding arbitration rather than in court.

Arbitration shall be conducted:

• On an individual basis.

• In English.

• Before a single neutral arbitrator.

• Under the commercial arbitration rules of the arbitration provider selected by Digjy LLC, unless otherwise required by law.

• In Maricopa County, Arizona, unless the parties mutually agree to another location or remote arbitration.

The arbitrator shall have exclusive authority to resolve disputes concerning the interpretation, applicability, enforceability, or formation of this arbitration provision.

Nothing in this section prevents either party from seeking temporary or preliminary injunctive relief in a court of competent jurisdiction to protect intellectual property rights, confidential information, or proprietary technology.

Class Action Waiver

To the fullest extent permitted by applicable law, you and Digjy LLC agree that:

• Any claims shall be brought only in an individual capacity.

• Neither party may participate as a plaintiff or class member in any class action, collective action, representative action, mass arbitration, or private attorney general proceeding.

• The arbitrator shall not consolidate claims involving multiple parties without the written consent of all affected parties.

If any portion of this Class Action Waiver is found unenforceable, only that portion shall be severed, and the remaining provisions shall remain in effect to the fullest extent permitted by law.

Time Limitation for Claims

To the fullest extent permitted by law, any claim arising out of or relating to the Platform or these Terms must be commenced within one (1) year after the claim arises. Claims filed after that period are permanently barred unless a longer period is required by applicable law.

Electronic Communications

By creating an account or using the Platform, you consent to receive communications from RecoveryBuddy AI electronically, including through:

• Email

• In-platform notifications

• SMS messages (where consent has been provided)

• Push notifications

• Website notices

• Electronic documents

You agree that electronic communications satisfy any legal requirement that communications be in writing.

Electronic Signatures

You acknowledge and agree that:

• Clicking “I Agree,” “Accept,” “Register,” “Continue,” or similar buttons;

• Creating an account;

• Using the Platform; or

• Providing any legally recognized electronic acceptance,

constitutes your electronic signature and your legally binding acceptance of these Terms under applicable electronic signature laws.

RecoveryBuddy AI may provide notices by:

• Platform notifications

• Website postings

• Account dashboard messages

• Other reasonable electronic means

You are responsible for maintaining accurate contact information within your account.

Assignment

Digjy LLC may assign or transfer these Terms, in whole or in part, without restriction in connection with:

• A merger

• Acquisition

• Sale of assets

• Corporate reorganization

• Financing

• Bankruptcy

• Change in control

• Operation of law

These Terms shall bind and benefit each party and their respective successors and permitted assigns.

No Waiver

Failure by Digjy LLC to enforce any provision of these Terms shall not constitute a waiver of that provision or any other right.

Any waiver must be in writing and signed by an authorized representative of Digjy LLC.

Severability

If any provision of these Terms is determined by a court or arbitrator of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified or interpreted to the minimum extent necessary to make it enforceable, where permitted by law.

If modification is not possible, the invalid provision shall be severed, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms of Service, together with the Privacy Policy, Cookie Policy, AI Terms of Use, Community Guidelines, Refund Policy, and any additional agreements or policies expressly incorporated by reference, constitute the complete and exclusive agreement between you and Digjy LLC regarding your use of RecoveryBuddy AI.

They supersede all prior or contemporaneous oral or written communications, negotiations, proposals, representations, understandings, or agreements relating to the Platform.

Relationship of the Parties

Nothing in these Terms creates or shall be construed as creating:

• An employer-employee relationship.

• A partnership.

• A joint venture.

• An agency relationship.

• A franchise.

• A fiduciary relationship.

Users, Peer Recovery Coaches, healthcare providers, organizations, and RecoveryBuddy AI remain independent parties unless expressly agreed otherwise in a separate written agreement.

Third-Party Beneficiaries

Except as expressly provided in these Terms, no person or entity other than the parties to these Terms shall have any right or benefit under them.

Compliance with Laws

You agree to comply with all applicable federal, state, local, and international laws, regulations, rules, and professional standards relating to your use of the Platform.

Nothing in these Terms authorizes conduct that violates applicable law.

Export Compliance

You agree not to use, export, re-export, or transfer the Platform in violation of United States export control laws, sanctions laws, or other applicable international trade regulations.

Headings

Section titles and headings are included solely for convenience and shall not affect the interpretation of these Terms.

Language

The English-language version of these Terms shall control in the event of any inconsistency between translated versions, unless applicable law requires otherwise.

Survival

Any provisions that by their nature should survive termination or expiration of these Terms—including, but not limited to, provisions relating to intellectual property, payment obligations, confidentiality, disclaimers, limitation of liability, indemnification, arbitration, governing law, class action waiver, and dispute resolution—shall remain in full force and effect.
