Peer Recovery Coach Agreement

This Peer Recovery Coach Agreement (“Agreement”) is entered into between Digjy LLC, the owner and operator of RecoveryBuddy AI (“RecoveryBuddy AI,” “we,” “our,” or “us”), and each individual who registers for or uses the Platform as a Peer Recovery Coach, Certified Recovery Specialist, Recovery Support Professional, or in another peer recovery support role (collectively, “Peer Recovery Coach” or “Coach”).

This Agreement governs your access to and use of the RecoveryBuddy AI website, mobile applications, WordPress plugin, provider dashboard, messaging system, recovery meetings, AI-powered tools, client management features, educational resources, and all related products and services (collectively, the “Platform”).

By creating a Peer Recovery Coach account or using the Platform, you agree to be legally bound by this Agreement.

Eligibility

By registering as a Peer Recovery Coach, you represent and warrant that:

You are at least eighteen (18) years of age or the age of majority in your jurisdiction, whichever is greater.
You have the legal authority to enter into this Agreement.
All information you provide is accurate, current, and complete.
You will promptly update your account information if it changes.
You possess any licenses, certifications, or credentials required by applicable law for the services you choose to provide.
You will comply with all applicable laws, regulations, certification requirements, and ethical standards.

RecoveryBuddy AI may request documentation to verify your identity, certifications, or qualifications at any time.

Independent Contractor Relationship

Unless you have entered into a separate written employment or contractor agreement with Digjy LLC, you acknowledge and agree that:

You are an independent user of the Platform.
You are not an employee of Digjy LLC.
You are not an agent of Digjy LLC.
You are not a partner or joint venturer with Digjy LLC.
You have no authority to bind Digjy LLC to any agreement or obligation.

You are solely responsible for the services you provide, your professional conduct, and your compliance with applicable laws.

Role of a Peer Recovery Coach

RecoveryBuddy AI provides technology to help Peer Recovery Coaches connect with individuals seeking recovery support.

The Platform may allow Coaches to:

Communicate with Recovery Clients.
Participate in recovery meetings.
Assist with recovery planning.
Share educational resources.
Encourage accountability.
Provide peer support based on lived experience.
Track recovery goals where authorized.
Collaborate with treatment providers when appropriate and authorized.

RecoveryBuddy AI does not direct, supervise, or control the content of peer support conversations.

Scope of Peer Support

Peer Recovery Coaches provide non-clinical, recovery-oriented support based on lived experience and peer support principles.

Unless separately licensed and acting outside the Platform under an independent professional relationship, Coaches shall not represent that services provided through RecoveryBuddy AI constitute:

Medical care.
Mental health treatment.
Psychotherapy.
Psychological counseling.
Psychiatric care.
Clinical addiction treatment.
Professional diagnosis.
Medication management.
Legal advice.
Financial advice.

RecoveryBuddy AI is not responsible for services provided independently by Coaches outside the Platform.

Professional Conduct

Peer Recovery Coaches agree to:

Treat all users with dignity and respect.
Maintain appropriate professional boundaries.
Communicate honestly.
Respect confidentiality.
Protect user privacy.
Represent qualifications accurately.
Avoid conflicts of interest.
Avoid exploitation of users.
Follow RecoveryBuddy AI Community Guidelines.
Comply with applicable certification requirements and ethical standards.

Artificial Intelligence

RecoveryBuddy AI may provide AI-powered tools that assist Coaches with:

Meeting summaries.
Recovery planning.
Educational resources.
Administrative tasks.
Documentation assistance.
Scheduling support.
Workflow organization.

You acknowledge that AI-generated content:

May contain inaccuracies.
May require editing.
Does not replace your independent judgment.
Should be reviewed before use.
Does not constitute professional or clinical advice.

You remain solely responsible for reviewing and approving any AI-generated information before sharing it with Recovery Clients.

Client Relationships

Peer Recovery Coaches are responsible for establishing appropriate expectations with Recovery Clients.

You agree to:

Respect client autonomy.
Encourage informed decision-making.
Avoid coercion.
Avoid exploitation.
Avoid inappropriate personal relationships.
Avoid financial exploitation.
Respect client confidentiality.

RecoveryBuddy AI is not a party to the relationship between Coaches and Recovery Clients.

Confidentiality

You agree to protect confidential information received through the Platform.

Confidential information may include:

Recovery status.
Recovery journals.
Personal information.
Behavioral health information.
Meeting participation.
Messages.
Contact information.
Uploaded documents.

You shall not disclose confidential information except as authorized by the individual concerned, required by law, or otherwise permitted under applicable legal obligations.

Healthcare Laws

If you are also a licensed healthcare professional, you remain solely responsible for complying with all applicable healthcare laws, regulations, licensing requirements, and professional standards.

Nothing in this Agreement authorizes you to exceed the lawful scope of your professional practice.

Security Responsibilities

You agree to:

Protect account credentials.
Use strong passwords.
Enable multi-factor authentication where available.
Secure devices used to access the Platform.
Promptly report suspected unauthorized access.
Follow RecoveryBuddy AI Security Policies.

Fees and Payments

If RecoveryBuddy AI offers paid services, referrals, subscriptions, or compensation opportunities for Peer Recovery Coaches, you agree to the pricing, payment, and billing terms applicable to those services.

You are responsible for any taxes associated with payments you receive unless otherwise required by law.

Intellectual Property

RecoveryBuddy AI, including its software, AI systems, workflows, branding, interfaces, documentation, and related technology, remains the exclusive property of Digjy LLC or its licensors.

This Agreement grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform during the term of this Agreement.

Prohibited Activities

You agree not to:

Misrepresent credentials.
Practice beyond your qualifications.
Provide false information.
Harass users.
Exploit Recovery Clients.
Circumvent Platform security.
Upload malicious software.
Abuse AI features.
Share account credentials.
Use the Platform for unlawful purposes.
Infringe intellectual property rights.

Violations may result in suspension or termination of your account.

Suspension and Termination

RecoveryBuddy AI may suspend or terminate your account if you:

Violate this Agreement.
Violate applicable law.
Misrepresent qualifications.
Endanger users.
Misuse Platform features.
Abuse AI systems.
Engage in harassment or fraud.
Fail to comply with RecoveryBuddy AI policies.

You may stop using the Platform at any time, subject to any outstanding obligations.

Disclaimer of Warranties

THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DIGJY LLC DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, OR CONTINUOUS AVAILABILITY.

RecoveryBuddy AI does not guarantee that use of the Platform will result in successful recovery outcomes, client engagement, referrals, income, or uninterrupted service.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIGJY LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO:

Your use of the Platform.
Your interactions with Recovery Clients.
AI-generated content.
Platform interruptions.
Technical failures.
Recovery outcomes.
Communications through the Platform.

Any liability that cannot legally be excluded shall be limited as provided in the RecoveryBuddy AI Terms of Service and applicable law.

Indemnification

You agree to defend, indemnify, and hold harmless Digjy LLC, RecoveryBuddy AI, its affiliates, officers, directors, employees, contractors, licensors, and agents from and against claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys’ fees) arising from:

Your breach of this Agreement.
Your peer recovery support activities.
Your negligence or misconduct.
Violations of applicable law.
Violations of third-party rights.
Content submitted by you.
Misrepresentation of qualifications.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of laws principles.

Any dispute arising under this Agreement shall be resolved in accordance with the dispute resolution provisions contained in the RecoveryBuddy AI Terms of Service.

Changes to This Agreement

RecoveryBuddy AI may update this Agreement periodically to reflect changes in applicable law, Platform functionality, operational requirements, or industry standards.

Updated versions will be posted on the RecoveryBuddy AI website with a revised Last Updated date.

Your continued use of the Platform after the effective date of revised terms constitutes acceptance of the updated Agreement.
