To the fullest extent permitted by law, RecoveryBuddy, its affiliates, officers, directors, employees, contractors, licensors, and service providers shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities arising from or related to your use of the Platform.

Where liability cannot be excluded by law, our aggregate liability for claims arising out of these Terms or the Platform will not exceed the greater of (a) the amount you paid to RecoveryBuddy during the twelve (12) months preceding the event giving rise to the claim or (b) one hundred U.S. dollars (US$100).

You agree to defend, indemnify, and hold harmless RecoveryBuddy and its affiliates, officers, employees, contractors, licensors, and service providers from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Platform, your content, your violation of these Terms, or your violation of any applicable law or the rights of another person.

These Terms are governed by the laws of the State of Arizona, United States, without regard to conflict-of-law principles.

26. Arbitration

Except where prohibited by applicable law, any dispute arising out of or relating to these Terms or the Platform shall be resolved through binding arbitration administered by a recognized arbitration provider. Arbitration shall be conducted on an individual basis, and each party waives the right to participate in a class action or class arbitration.

Nothing in this section prevents either party from seeking temporary injunctive relief to protect intellectual property or confidential information.
